COMES NOW Plaintiff, TONY WHITE, an Individual, by and through his attorneys of record, HARRISON, KEMP & JONES, CHTD., and SANTORRO, DRIGGS, WALSH, KEARNEY, JOHNSON & THOMPSON, and for his Complaint against Defendants, HEWLETT-PACKARD COMPANY, a Delaware Corporation, DOES I-X, and ROE CORPORATIONS XI-XX, alleges on behalf of himself and all others similarly situated the following upon information and belief:
I.
INTRODUCTION
1.This is a class action for damages that Plaintiff and all others similarly situated have incurred due to their purchase of the HP DVD100i - a first generation DVD+RW disc drive- for their personal computers. Defendant manufactured, marketed and/or sold these drives with the representation that they would be able to write the less expensive DVD+R discs once those discs were released, which would also be compatible with a substantially greater number of CD and DVD players. However, those promises began to ring hollow in April, 2002, when the DVD+R discs were introduced into the marketplace and Defendant admitted that the formats are not compatible and that purchasers of the first generation drives must purchase a $99 “upgrade” in order to obtain a drive with the features originally promised in the first generation DVD+RW drives.
