Audio track being encoded even when audio is deactivated

When working with a .vob (2 audio tracks), no matter what I do in the Audio tab I keep getting an audio track encoded in high bitrate (200) with xvid and mpeg4 (mencoder) - remember I've had this issue for a long time Major !?

Well I've figured one thing, the unusual audio bitrate happens only when VBR setting is used (which doesnt explain why it results in 200kbps) otherwise with ABR its normal. But the real problem remains : when encoding from a .vob and unchecking audio, mencoder still processes the audio track
