so i have the following file (mkv):

    Video
    ID : 1
    Format : AVC
    Format/Info : Advanced Video Codec
    Format profile : Main@L5.1
    Format settings, CABAC : Yes
Format settings, ReFrames : 2 frames
    Codec ID : V_MPEG4/ISO/AVC
    Duration : 1h 30mn
    Width : 1 280 pixels
    Height : 720 pixels
    Display aspect ratio : 16:9
    Frame rate : 25.000 fps
    Color space : YUV
    Chroma subsampling : 4:2:0
    Bit depth : 8 bits
    Scan type : Progressive

    Audio
    ID : 2
    Format : AAC
    Format/Info : Advanced Audio Codec
    Format profile : LC
    Codec ID : A_AAC
    Duration : 1h 30mn
    Channel(s) : 2 channels
    Channel positions : Front: L R
    Sampling rate : 44.1 KHz
    Compression mode : Lossy

i wan to keep the video quality and audio quality as it is, i only want to change the container to avi. So i open up Xvid4PSP 5 and choose the following settings:

    Format: AVI HArdware HD
    Denoise: Disabled
    Brightness: Disabled
    Video encoding: Copy
    Audio encoding: Copy

but everytime i get an error saying: "The function DeleteComments was called on a stream[?] that hasen't been initialized with SetSource"

what to do? I guess this is due to the option AUdio encoding: copy. I've even tried to encode the audio to another format, but then there is no sound in the video only an awfull error-like sound!

You could try avidemux, under video and audio choose copy, format: avi and save as avi.

But why? For computer playback leave it as mkv. And most other devices does not support avi with avc video. Maybe convert to mp4 instead then, https://www.videohelp.com/tools/sections/all-in-one-mkv-to-mp4-avchd-ts
