ibm has a file on their public ftp of ibm recordnow max 6.5(newest).. its the same as the retail one, it just has an ibm badge on it.
i think you need to have an older version of ibm recordnow max on your computer to install it.. its kind of like an upgrade.. but it does a full install.

I would still consider that to be warez.
I also consider IBM to be rather lax in their security as well.

If it was the RecordNow version 6.5.3 from 11/19/2003, it wasn't exactly hard to find. Only took about 5 minutes and a file called all.... located on the server. Nice ftp, I'm glad they went to so much trouble to make it easy to find things, wish Epson did the same

I suppose this would be warez because you are getting the full version, but there are others who could argue the other side. It reminds me of a dedate with others I had about No-CD cracks for games. I said that the crack themselves were not warez because they had a great application in a legal way, it becomes a pain to insert a CD for every game you own sometimes, but I suppose everyone has a side of a story.
