Its like in the pure black scenes that the color like fluctuates or moves...I thought it was banding, but am just not sure... I can provide a clip of it in motion if need be.

Isn't this kinda normal for black parts in heavily compressed movies?
Give more information about the video source.
And I changed your thread title so it includes the issue. -
I guess its common, but now that I look at the source it is there too even before encoding it
It normally doesn't bother me, but its there during the scroll of the credits and is quite ugly. I guess I'll just have to deal with it. -

all i see in your screenshot is a lighter area which could quite likely be a backlight issue of the display device.

If your player or decoder's deblocking isn't turned on yet, that may help somewhat.
Although Manono's suggestion is the best, especially since the problem sounds to be isolated to monochrome scenes.
