Is it intelligent, as in cutting at chapter points found in the IFO, or will it just split the movie into parts of perfectly equal length to fit it on the required number of CDs?
It would seem unacceptable to me to have a cut right in the middle of an action sequence or dialogue.

It cuts based on size in bbMPEG. So yes, in theory you could cut at bad point right in the middle of an action scence or dialog (oddly enough this has never happened to me).
If you are really concerned, notice that the newest verisons of the program allow an 'overlap' between discs. So the next disc can have 1-10secs of the ending of the previous disc.
