is there an authoring program that won't reincode a captured m2v file? (that let's you decide what audio & video bitrate to author & burn to?)

TDA, DLP, DVDWS2 will take compliant and author without re-encoding. If it isn't complaint, YDA and DLP will not author, and DVDWS2 will re-encode. I would use imgburn2 to burn rather than the built-in burbing facilities of an authoring tool.

i guess another question is what is the spec for compliant for those? i have ulead movie factory 4 & it looks like high number is 8264. i have a phillips 3040 dvd player & i seem to recall the high was 1500 bitrate. i want to go at 9800 video & 284 audio. will gui for dvd author do that?

See What is DVD (top left corner of this site) for compliance. Total allowable bitrate is 10800 kbps (combined audio and video). Some players will not happily play bitrates this high from burned media. I have had success with video encoded at 9200 + 224 audio.
GUIForDVDAuthor will allow you to go to the limit, however it may not play well on all players, and you need to be sure your encoder hasn't spiked at any point.Read my blog here.
