I have an interesting situation. I sold a cell phone two months ago and everything went ok, he got the phone, i got my money and spent it.

Now paypal has reserved the transaction because they say he used unathorized funds so now he has the phone and I owe paypal 130 dollars.

They say I'm not covered under seller protection plan.

Do I have any legal options? Can I sue because I fullfilled my part of the buyer seller contract? Should I have a collection agency go after the man to get my phone back.

I'm really pissed off about the idea of not getting the phone back and owing paypal money. I've so far refused to pay them back until I get the phone.

I'm not sure what to do.

  2. Paypal are ******* wankers. Had you already withdrawn the money?

Or have they put you on a negative balance?

  4. They do not have a leg to stand on. Tell them to **** off let them threaten you they can't do crap. If you need a lawyer I will represent you.

They did a similar thing to me about 9 months a go and froze my £2,000 balance for six weeks. There complete morons. There customer service reps are mindless automotons and the second you ask a question which they are not pre-programmed with the explode.

Fuckers (as you can tell I am not a big fan of paypal)

I don't know the legality of this for sure, but I don't really see how you can possibly be held responsible. There is no way for you to verify that the other guy's payment is valid. That is the job of Paypal, and the whole reason they are even involved in the transaction. They should not release the funds to you until payment to them has been authorized. That's what a middle man is for.
