miniDV to SVCD

Can anyone help me with trying to convert from miniDV to SVCD? Here are some specific need I have:
1. What shareware is best for "capturing" over IEEE1394 and saving in a AVI file format that TMPEGenc will accept? I think I am having problems with DV type 1 vs DV type 2 format. I use MGI's software to capture (as an AVI) however I can't get TMPEGenc to read it directly. I also can't get TMPEGenc to read it when I frameserve the avi with VirtualDub.
2. Is there software I can use to frameserve directly from my miniDV camcorder over IEEE1394? I know I would lose my editing capability, however I wouldn't need to save a huge file.
3. Does the camcorder set the DV type (type 1 or 2) or the software CODEC?
