Hi
I live in the UK and was hoping someone could clear a few questions up for me.
1) Is it illegal to download movies (e.g. DVDrips) and music cd rips or is it just the sharing that is illegal??
2) And as far as the illegality is concerned is it a criminal offence in the UK or is it just a civil breach of copyright offence??
Any other information concerning this would be appreciated.
I know a lot of people are confused as to what is actually unlawful and what is not.

1. Yes, it is illegal. Those "sharing" are breaking the law as much as those who download it. You are breaking copyright and can basically get done for theft and copyright issues.
2. It is ILLEGAL. Period. They'll do you for something.

Warez includes downloaded copyrighted movies, movies that are not yet released on VHS/DVD and copying rented movies.

"i went to blockbuster, got pirate of the carribean and made a backup"
that would sound illegal, but what some people dont realise is that blockbuster also sells movies. -

I was only asking because I have read many articles which confused me as to what was legal in one country and wasn't in another.

Who really cares where you bought movie X? We really don't need that information, but when it is given in such an ambiguous fashion and in the context and location the question is posted, you have to expect those kinds of responses.
A better way to phrase the question to help avoid such "witch hunts" in the future might be, "I bought POTC, and I need help makign a backup". -

Is it legal to download a movie you own? Like you legally own one copy of The Matrix on DVD. Now you go and download another copy for backup or whatever, wouldn't that be legal?

I've asked that very same q before, and the answer came out "No.".
It's a bit of a grey area, but I can understand why that wouldn't fall under "fair use".

Actually, if you download from a legitimate source of media and have enough proof they are honest, then if you have paid for what you download you are legitimate.
Like SONY has started a pay-per-download service. You pay and download. This is legitimate.
Also, MP3.com had a download service for music. Unknown artists had their entire albums free-of-charge for downloading them in MP3 format. That was also legal.
Burning these tracks on a CD and selling it, well that's illegal.The more I learn, the more I come to realize how little it is I know. -

U.K. indivduals who have been charged for sharing pirated music have been dealt with under the trade practices/copyright acts which have both a civil and a criminal component. -

Unfortunately, Fozzee, I think your first post made it tough for a few forum members to answer concisely and accurately. Warez includes downloaded copyright movies and if a member were to tell you that it was legal/moral to download then by my reckoning they would be advocating warez. Anyway, not my issue !
Without living in the UK I have no understanding of UK law but I won't let that hinder me. My thought would be that the act of placing the film up for sharing is the illegal act - fair use implies for your own private usage - not sharing with others. Sharing with others is the same as public broadcast IMHO. Downloading wise, you have no rights under fair use because you do not own it and that is why this site offers no support whatsoever for cases such as this.
In summary, I would think that both sharing and downloading are illegal to the letter of the law.
Then we come to the moral dilemma and reality check. In reality, you certainly would not get raided by the cops because of your 200 strong VCD collection that is for your own personal use.If in doubt, Google it. -

this whole site in gernaeral is funny. Its like me making a website that gives guides on how to make counterfit money. I state... No discussion on the making of REAL counterfit money is allowed.. these guides should be used only to reproduce your own custom made Valueless money. Even tho i would state that on the site... every1 who vists would be using the guides to counterfit real money. I think its all a legall thing.. if DVDrhelp.com forums say no discussion of warez then they can get away with the fact that thier supplying the how-to guides once the files have been aquirred by the user. This way its perfectly legal to supply how-to guides cause they state its for personal backup only. -

The secret to this site is how you ask for help. Site rules say no help to be given for downloaded or rented copyright movies. Therefore if you do not disclose how you acquired the video then one must assume that you own it on DVD or VHS. I don't know about that stat of 95% - for all you know a lot of people own DVDs and are simply backing them up under fair use - and pigs are flying in the background
A lot of people are only backing up what is rightfully theirs and not everyone is as sinister as you areIf in doubt, Google it. -

I agree with you that many things about copyright law are unclear in various countries. I live in Canada and some people I've heard discussing this have totally misunderstood that it's ok to download and copy music that you do not own. What was said is that it would be more difficult to gather evidence and win a prosecution according to the interpretation of current legislation. I'm not aware of any mention of css encryption and it is generally recognized that it is ok to backup music or movies that you possess. Some experts have inferred that it could even be argued that the original does not have to have been obtained legally for the backup to be legal. Twisted minds these lawyers.

lol thats kinda true.. but I still find it funny that that guy flipped out cause were not allowed to talk about warez on these forums but about 95% of the people here copying DVDs are doing so for downloaded/rented dvds lol.

well I know tons of people in real life but not so much here on the forums. Of course im not gonna snitch on them cause there all working class people and I dont think its fair for billion dollar corportaions to sue a guy who works 2 jobs just to stay alive heh. I feel sorry for all those folks who got busted for the pirating and what not.. If I were rich I would pay thier legal fees.
