    Accuser says Daigle also sought nude photos for murder probe :P

    NORWICH -- A woman who accused Norwich Police Lt. James F. Daigle Jr. of taking topless photos of her as part of an underage-drinking sting filed a second notice of intent to sue the city Friday.
    According to attorney Dado Coric, Daigle also recruited Theresa Earl so he could take nude photos of her as part of an ongoing murder investigation.

    "This was in mid-August 2001, a few weeks after the July 21 underage drinking sting," Coric said.

    "She was told that the murder suspect was also a child pornographer and the photos were to be used in that context," he said. "They would be used to try and catch him."

    During the July underage drinking sting, Daigle told Earl, 20, of Groton, he needed to photograph her to show that she was not carrying identification or wearing a wire, Coric said.

    "This time he upped the stakes by telling her the police were trying to catch a murderer and she volunteered," Coric said.

    The only unsolved Norwich homicide is the death of Todd Withycombe, who was clubbed over the head June 12. His body was found in an alley behind Otis Library on Main Street.

    The nude photos were allegedly taken by the swimming pool at a private residence in Preston near Amos Lake, according to a notice of intent to sue filed against the city on Earl's behalf.

    Neither police department lawyer Harry Calmar nor Daigle's lawyer, Charles Norris, could be reached for comment Friday night.

    The first accusations of misconduct against Daigle were made by Kristen Ejchorszt in a complaint filed Dec. 3. Ejchorszt said Daigle took nude photos of her for an underage-drinking sting in November for which she had volunteered.

    She accused Daigle of taking topless photos before and after the undercover sting to prove she was not wearing a wire.

    Also, Ejchorszt claimed that Daigle and Detective Mark Lounsbury drank alcohol during the Nov. 30 underage-drinking operation.

    Daigle was placed on paid leave Dec. 7. An internal investigation into the allegations has been ongoing since the first complaint.

    Since Ejchorszt and Earl came forward, a third woman -- Melanie Wilson -- also had alleged Daigle took topless photos of her for an underage drinking sting in September 2000.

    "Considering the girls didn't even know each other, the parallels are striking," Coric said.

    Coric said he waited to file the complaint until now because he had to investigate it fully.

    Intent to sue the city? Why not just sue? Or is the intent thing supposed to intimidate them into a settlement?
