Ok, with all the copyright infringement lawsuits going on these days, I was wonder if it is legal to download MIDI files from site like http://www.mididb.com/ and play them on your computer. Your comments/inputs please.............

Midi files are once removed (at least) from something like a rip or MP3. It's almost like a cover version of a tune. If anyone would be in trouble, it would be the creator of the midi.

A midi would be considered a derivative work. A cover band's performance would be considered a public performance of the original. Both of these things require permission from the copyright holder but are such minor things that basically small timers don't bother and nobody cares.

Like look at American Idol. You can bet they have permission and pay good royalties to let their contestants cover those songs. And something like a service which sells midi ringtones would do the same. Also if you had a cover band like Hayseed Dixie (Country versions of ACDC songs---MUST check it out!) they probably pay some royalties too. Or when Metallica decided to cover Turn The Page, etc...

As far as your liability for downloading/listening to unlicensed works or displays, it could happen on a couple of different theories but not unless you had knowledge that the creator/performer didn't have permission.
