If you buy a dvd download....can you then legally, resell that DVD on Ebay ? I have never downloaded any DVD but if I could recoup some of the cost like other purchased DVDs I might consider it.

If it's a download, you arguably have the right to resell it, but very likely the publisher will say you can't, and eBay is likely to go along with them if you describe it like that -- they will stop anyone reselling Windows software, despite it being perfectly legal, because Microsoft doesn't like it. -
If you pay for downloaded movie, I am sure there are some rules for that.
Even if they are not, look at the end of the movie, there would be something like, this is a property of whoever made a movie and any reproduction in part or whole is not permitted, so to burn it and sell it go against that part. -
The question is...why would anybody buy a burned copy when they can buy a used pressed DVD for <$10USD?
If I buy a DVD I want the artwork and original case.
