Ok. So here is my problem:
I have a site admin who is being a penis. He is constantly monitoring my bandwidth usage on my workstation and reports any peaking bandwidth usage to my employer. It is really ticking me off because when ever I stream audio or video from websites like Yahoo Launch or Comedy Central, I peak and then get in trouble. Now, you might tell me to stop visiting these sites or downloading anything that would use a considerable amount of bandwidth and I wouldn't mind doing that if I didn't know that he himself not only uses up mass bandwidth on streaming media but also uses bittorrent and emule to download pirated software.
What I need is a program that will allow me to monitor not only bandwidth across the network but also the downloads and bandwidth specifically for his workstation. If you know of any free ware that would be great and something user friendly, ya know, for a dumbass who doesn't know a lot about what he is doing.
I could let it go, sure, but this is ridiculous. He tells me he has not given the company a reason to NOT trust him, but then neither have I. So he hasn't been caught wasting bandwidth, that doesn't mean he is trustworthy. I just want to get this guy off my back by having something to rebuke him if he should report me again. Somebody has to watch the watcher.

Well if you know he is downloading (pirated software) then use that on him. You must know somthing if you know this. Screw him.

Tell you boss you're being blackmailed by this guy. And be sure to report a detailed summary of his activities. A great many employers don't care if employees listen to music while at work. In fact, many studies show listening to music helps you concentrate. What you're doing is merely the digital version of this, and the network admin is not your boss, so he can essentially go to hell. Better yet, go have a chat with HIS boss about his godly abuse of power over others. This guy may well be breaking company policy in regards to how he monitors.

what i would do is report him the the BSA (http://www.bsa.org/) or microsoft, or any of the other many companies he's ripping off..
he'll probably get fired (at the least) for misusing company resources. its not like you're doing illegal.. you might be doing something that is against company rules, but its not illegal.. what he's doing is probably against company rules & against the law. -

You were breaking company rules. Request to have those restrictions altered if you want. Don't play silly buggers and complain about the guy. You know how that would look. Forget the port scan or packet sniffing approach. If this guy has policy access he can see you coming and going.
Comply with the rules and get on with life. If you need to, find another way to get revenge. -

i used to download heaps from work cause of the quick connection, but now that i have dsl at home i don't bother, why risk it.
there are all sorts of other nice things you can do while at work. like checking other peoples machines for mp3 files, lots of people have stashes. or you could trawl through others internet cache for their hotmail messages, can be very insightful on the practices of your work colleagues, look for filenames that have getmsg in the filename. btw this doesnt work on your own profile.

The bottom line is that you're screwed by a Master. Anyhing that you can throw at him, he'll deflect. Say you tell on him. He simply wipes his tracks and you look like a boob. He then rats on you in return, and knows exactly where to look for your "stash".
This is akin to a beginning karate student asking for some "quick tips" on how to beat his instructor/sensei. -
Thanks for your responses and encouragement. I suppose it would look bad if I were to do the same. I decided to confront the bastard about his personal website hosting from company computers, his streaming of music and online game playing, and his use of bittorrent to download web authoring tools. I have been able to persuade a fellow employee in his department to back me up if needs be. This employee remained neutral through all of this guys dealings until he started pulling this Stasi crap.
It was funny. When our admin asked my spy to get rid of any .mp3s or video on his system, he asked him if he wanted him to get rid of Dreamweaver and Photoshop that the admin pirated for him. The guy had the nerve to say "No, just the audio and video." I suppose it is ok to pirate $1000 programs but hell no to the $20 video or music cd...lol. My spy then refused because most of the audio and video is stuff he brought from home and is not sharing, nor is the video copyrighted. My recently acquired ally said he will come to my aid if this Nazi tries anything again. If the owner has a problem with my bandwidth usage, then he can pay the $2000 to buy legal copies of Dreamweaver and Photoshop. -

Lodsmurf is right, make sure that you are not breaking any written or implied rules. Get your act together and clean your trail as best that you can. Decide if a confrontation is worth the risk and confront managament. Let the management know that if "anyone" is caught downloading software and breaking the law, that it is not the cost of the software that they will be paying for. I would ask management if they will allow you to use their system on lunch or after hours to do personal projects. Very few of us are angels, and I can see the company having concerns about what you do while on company time. I am kind of old fashioned about work ethics (I may not practice them all of the time, but I do know what is right and wrong) Keep in mind that this dude was hired to help keep you in line,(I ASSume) and you may be holding the short straw. That is, right or wrong, the company may take his side in any dispute.

The Site Admin has been authorized to monitor bandwidth as a measure to prevent illegal downloading of copyrighted materials such as videos, music, and software cracks etc. There is not a company policy about bandwidth but the abuse of bandwidth has been rampant. I was caught downloading an illegal movie and when confronted I admitted to my guilt, apologized to management, and cleaned up my act. However, when I mentioned my concerns that nobody is watching the watcher and that the watcher is known to be guilty of bandwidth abuse and illegal downloading of software, I was told to mind my own business.
What erked me was that the reason they chided me on my download was because it puts the company at risk and when I wanted to help is reducing liability to the company by reporting other illegal activity, they told me to shut up and mind my own business. To me, this is hypocritical. So I confronted them all, the site admin and upper management. I cleaned up my act and apologized. I was assured that I would not loose my job and they thanked me for my concern but idealistically encouraged me to manage myself and not worry about what others are doing.
Number One: If I am to worry about myself and this is what is to be expected, why don't they require the same of the site admin?
Number Two: If I am a risk to the company due to my illegal download aren't they who likewise engage in illegal activity also a risk to the company whether they have been caught or not?
The stories and counsel I am getting is full of hypocricy and cover up, but I gave my two cents and that is all I can do. Now I move on and make sure not to make the same mistake twice. Hopefully, the company will be as honest as they hope their employees will be. -
Do as we say not as we do. I was affraid that you would not be the one the company sided with, I have seen this kind of stuff before. I am not one to promote revenge and this site is not about dirty tricks, but if your morals are lets say of a high caliber and the fact that some poor software company is being taken advantage of. maybe that software company should be made aware of what is happening around there. Or you could just bite the bullet and take whatever comes your way. I suspect that you have drawn attention to yourself that you didn't really need, watch your back.

Yes I do need to be careful. They sat me down and had a written warning made up for me to sign. The warning essential acknowledges my guilt and that I will not do it again. The first draft I refused to sign because it stated that I would consent to not DOWNLOADING ANYTHING. When I read that I laughed in the owner's face and asked him how I was to do my job if I could not even open a browser. So they rewrote it stating that I agreed not to illegally procure copyrighted video, audio, or software that was not legally purchased. I signed that one. So now they have a file on me, but I if they fire me later over a technicality, I will certainly report them. So they better have their crap smelling like potpourri.

Dear [Business Owner 1],
I am writing you this email in hopes to regain your trust in my business dealings as an employee at [Company Name]. I do express my deepest apologies for my recent error in judgment, to have placed your company at risk for having fulfilled selfish desires with an illegal download. I understand the repercussions to your business if found in the possession of pirated material, whether video, audio, or software, as well as the implications that are incurred by an employee caught engaged in such activity.
I do not wish to be seen as a liability to the company and wish to help in cracking down on violators of this policy. However, I do not wish to participate in this effort with the intention of pointing fingers or holding my fellow employees’ employment in the balance, rather to protect the company and the longevity of our teams’ employment at [Company Name]. Therefore, it is my hope in this email to bring to your attention activities that may be of concern to you as the business owner as well as it is my hope to show my desire to be a continued asset to the [Company Name] team. There are a few concerns that I wish to express if we (assuming that you will have me along in this endeavor to stamp out employee corruption and illegal activity) are to be successful in making a clean sweep of our individual business dealings with regard to company policy.
My first concern is that those chosen to watch over the company network are not themselves being watched. I feel that such measure to engage in a security effort needs to be monitored and supervised by one who does not have something to gain by implicating fellow employees or thereby being discreet about one’s own activities. I do not feel those you have chosen should be the watchers over the company. It is my personal feeling that this job should be his who is supervisor over all activities, to include those of the IT, Support, and Repair departments, namely [Business Owner 2].
My second concern is that an investigation, while authorized by yourself and carried out by IT management, has not at all been comprehensive. In the limited access that I have had to the network, I have come across 21 recognizable applications (15 of which are listed below) that are pirated or have not legally been acquired and are at present in use illegally. It seems to me that when you asked IT to scower employee workstations, he not only neglected to do so, but neglected to investigate his own drive or that of support and repair. The majority of the programs, which I will here after list, were found primarily on Support, Repair, and the Application Servers. I have no doubt that I would have found many more had I access to the IT server; but since he has it on lock down and would not allow me a thorough investigation of his workstation, I am not at this time able to confirm whether he can or cannot be trusted. For these reasons alone, I believe that any effort to secure the longevity of business at [Company Name] will be futile unless a business owner makes an impartial, unbiased, nondiscriminatory, and non-collusive investigation of all workstations.
The following are just a few of the common applications pirated and downloaded that I have found in my limited access to workstations on the Network. This is by no means a comprehensive list and such a list cannot be obtained without a full-scale investigation of all servers:

Many of these programs have been authorized for distribution by [Business Owner 2] and IT and are not limited in use to the servers mentioned above but may be in use across the network. This begs the question as to whether illegal downloads and pirated materials remain an exception to the rule in such cases where it “benefits” the company? I have in the past run pirated copies of Eudora and at present use pirated copies of Adobe Acrobat Pro and Microsoft Office in order to do business. Such applications have been distributed to myself for the facilitation of business in my department by ownership. There is no doubt in my mind that many of the workstations currently run pirated illegal copies of email services, text and spreadsheet applications, and viewing document software. It has also been brought to my attention that much of our webpage has been the constructed product of pirated illegal software--downloaded, no doubt, with Bittorrent by the manager with whom you have given special privilege to monitor the network and her workstations without necessitating a report of his own workstation and downloading activities.
The vast amount of illegal activity going on in the company with regards to downloads, along with the selective nature being applied in reporting violators by those whom you have chosen to empower in this monitoring, leaves many doubts that the wiping out of illegal activity and stored pirated applications will cease or be found lacking on [Company Name] servers and workstations anytime soon. I am guilty and if you wish to release me of my duties because you feel I may have become a liability to your company, then I will not fault you for keeping company policy. However, my intention is to protect the company in its entirety and this cannot be done by the selective investigation of only a single server on the network nor empowering a manager who will never disclose his activities or those of his friends. I do not wish to lose my job and have taken measure to come into compliance with company policy. My only concern is that if I am to be viewed as a liability for having been caught then how much more a liability are they who do the catching but disclose not on themselves.
I hope you will understand that this email is not a push of vindictiveness towards those who are doing their job or towards the Company and its policy. NO! My intention, if it truly is your own also, is to apologize for my indiscretion and error of judgment and to show my willingness to comply along with my willingness to protect the company by requesting a full scale investigation of all servers and also by requesting that such an investigation and the future security monitoring of the [Company Name] network and her workstations be performed and carried out by an owner overseeing operations. I can only express my appreciation that you have not cut short my employment in your company at this time and I hope informing you of my limited findings during my limited investigation will inspire you to conduct a full investigation across the network. This I offer you as restitution for my infraction.
I do hope we can see a day soon when [Company Name] is in full compliance with copyright laws and her employees in compliance with [Company Name] policy. Please accept my gesture to protect your company by placing authority to monitor the network and her workstations into the hands of an owner as well as my gesture to conduct a full scale investigation into every workstation on the network by an owner as the means to eliminate pirated illegal copies of applications being used to further [Company Name] productivity. In the end, the productivity acquired from the use of such illegal applications in [Company Name] business is productivity acquired in violation to the law and while it is now determined to be an asset, it may in the future become a liability.

Too late now, I would have adviced not to admit anything in writting. I would also advise brushing up on writing resumesDepending on how tight your company is and the social-political environment, you may be out of work. If pissing matches are the norm then you may have pulled a good one. You need to be straight with your employer and tell them "that we are all angels or we are all thick as theives" You have a better grip on what your work is like than I do. I have heard radio ads that claim illeagle software use fines in a bussiness can be as high as $500,000 for each offence. (Maybe just a scare tactic, but something to think about)
A couple things to think about,
If you do get fired, it sounds like you don't want to be hooked up with that kind of bussiness anyhow. (I would drop a dime on them if they fired me for this)
If they keep you, you will have to watch your back forever unless they wake up and call a truce. And then you need to get your signature back. Call it a truce with mutual assured anilhation, there are no inocents here, no need for everyone to go down, let's all get back to work, don't mess with me and I won't mess with you.

Well I guess it looks like I got the good one pulled on me! I guess we will just have to see what happens once they get all their software up to date. I think they are worried about me reporting them to the BSA and so that is why they sought a signed confession. I wasn't looking for anything legal anyway. These people are just shady.

LNielsen76, it's like this: Downloading any type of Warez from work is not only illegal, it's just plain stupid. However, the one thing worse than an employee d/ling warez is a Site Admin doing it. If you think they are going to get rid of you, my advice is to inform the above companines (Adobe, Macromedia, etc) that your company is a bunch of thieving rat-bastards. A Site Admin should know better, and if they enforce rules on employees and not themselves, better it is that they get nailed.

The BSA ads are for real. Every year than ran in market where I used to work, the IT guys would run around and re-image "certain" computers. The ads always seem to run about reveiw/raise/layoff/downsize time.....

As you have now caused management to take notice and start poking around in everyone's workstation, and have involved *all* your co-workers in this whether they're allies or foes (since everyone was probably doing it and now has to clean the stuff up from their comps), and as in a few months from now you'll probably be lining up at your local unemployment office reviewing these events in your mind (because, come on, you know they're going to be gunning for your butt from here on out and how many allies will you have left by the time this happens), is it all really worth it?
All this, because you had gotten into the habit of downloading from work which was really only intended to be a convenience for you, and suddenly that perk was taken away. A perk which you legally never should have had in the first place.
Why didn't you just get yourself a high speed connection at home and download till your hearts content? What is this great hurry to get these movies so quickly and why can't it be done on your off hours? So what if this guy continues to download and break the rules behind managements back, how does that affect you or your work performance in any way?
I agree with you that what he did to you was not fair. I understand why you were upset. But that said, is it worth putting your job in jeopardy over it?
If the answer is yes, then you come across as a very vendictive person. In the end, that's all your bosses will see and will fire you for that alone. It's a no-win situation. -
To fight corruption whether it costs my job or not is entirely worth it. I will not be held to a hypocritical double standard. If it is so important to them then I have no qualms with being fired. To come into work knowing that I am being held to a double standard does not make for a productive or friendly environment. IT IS TOTALLY WORTH IT!
Do I have expectations that I won't run into the same problem at other companies? Not real expectations, no. The owners are my friends and it hurt that they turned their backs on me when confronted with their own crimes. It is obvious that they were not friends in deed, rather in word only. I can not be part of a situation where I am under constant surveillance for actions that are no doubt being undertaken by those watching me. IF the company wants to stand by this site admin who is not a friend rather than I who am, then it only goes to show how quickly they are to trash a friend for someone they feel benefits them more. If they don't clean up their act and they want to fire me, then so be it.
It is worth it. I wouldn't want to work for a bunch of lying, cheating, hypocrits. I admitted my mistake, apologized, and promised not to do it again. The ball is in their court and if they can't handle my assists then I don't want to be on their team. -

Nobody had to spell the rules out to you because you already knew them. They didn't have to write a memo to inform everyone that downloading illegal software is wrong cause everyone already knows it so grow up.
