I was aressted a couple weeks ago here what happened.

2 drunk guys where banging on the door across the hall from me, so my girlfriend asked them to stop, they made a face at her I went out and was yelling at them to stop one of the men grabbed my throught and tried to tackle me I punched him in the face around 4 times.

I was charged with Assault cousing bodly harm do you think I will get conviticted the crown is asking for jail time.

was this justified I think so and I would do it again if someone trys to harm me.

Did you have marks on your neck? Did you takes pictures if you did? Did you have any other witnesses or written detail from others that might have heard the "commotion"??
If you have these things I doubt you'll face any serious penalty... but then again with the state of our so called "justice" system you never know...

and I have 9 proir convictions must are from YO but 3 are from 9 years ago as an adult.

I'd have to agree. I could never stand this need for adult males to make themselves feel more manly by attempting to beat the shit out of each other. Nine times out of ten, there was no "throught" grabbing. In most of these situations its just words followed by someone sucker punching someone else.

It's clear to me that if you had trouble in the past you'll find in the future. They arrested you because they knew you (And maybe the others were rookies).
Next time think twice before have fighting with somebody, without training. As a martial art expert as I am, you let him grab your trough first. That's a mistake. If he was a bad guy, you could have more damage than what you did. Lucky you, he was an hassole. But you aren't so expert If you need 4 punches to fix the problem.
If you must give a punch to somebody, give only one punch, strong enought to make your enemy fall down. And move your ass out of there, fast. Both things (Giving one, strong punch than escape) needs training. More training you'll make, less time you'll find useful giving punch to somebody.
With a good lawyer you can sort out this story.

Courts don't typically let you off for self defense if you were the provoker. Even though he made the first contact, you went out there yelling at him.

I don't know how UK laws are but if they are anything like American laws then evidence of your prior convictions won't be admissible at trial (unless you open that door), though they can be raised during sentencing if you are found guilty.

BTW: make sure you realize what exactly you have been charged with. The "assult" is just the threatening to do harm. You very well may have committed the assault before he even grabbed your throat if you stated that you were going to harm him and made a physical gesture.

The causing of bodily injury portion is just another way of saying battery. Assault and battery are two distinct charges. You can be convicted of one and not the other.

well my 2 cents would be I have to be very careful ( I dont now what your other cases were ) but it seems from what you tell us is that you and your GF like to be proactive ..and yes I would of called the cops that way if anything happened it would be on record that I was the one that called.. and all of this would of been avoided...next time think about it before making any actions and have your girl to help you think, every action is going to have a reaction. dont know what really happend but good luck..

Why oh why punch the guy? why be close enough for him to grab you? you must have got close to him, as i don't see how you could avod escaping a drunk. they are slow and unco-ordinated.

I remember getting a beating five years ago. i was set upon by three guys and one of their bitches. i was bloodied and bruised and they were callng for me to punch them back. i refused every time. show some self control, both you and your drunk friend deserve punsihing. can i suggest ECT?
