I'll mess around sometimes trying to find web or ftp servers, and see what they got.

Terrorism really??!!!??! thats a load of crap, if somebody has a server running to share stuff how else am i gonna find it, LOL. I havent been notified by my ISP so far. -
Been pinging servers forever....
Back before Veronica, Finger and Gopher I used to use a "war game dialer" to try and find machines with modem lines just 'a waitin' to be hit.
I remember I would just say dial xxx-xxx-1000 to xxx-xxx-9999 and just let it go.
Those were the days... 286's, Epson Dot Matrix and Dr DOS. -

I dont think its illegal just to ping , or check for open ports. I think its if you act on that, then....the shit could hit the fan

in it's self -- scanning in not illegal , but some types of it are .. it is a grey area (for example = google is scanning all the time) ... the problem is that the patriot act says you can not connect to another computer without their consent, so if you scan for lets say ; ftp sites , you have to connect to that site to see if it anon .. it is a real mess , but overall most ISP will drop you if you are reported as scanning and all GOV systems are now required to report scans to your isp .. as well as many other institutions.
ISP 's have different policies and how many warning you will get (or none) .
if you read your user agreement - many will have this clause or one like it:
You are prohibited from violating or attempting to violate the security of any server or system or network , including, without limitation, (a) accessing data not intended for such user or logging into a server or account which the user is not authorized to access, (b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization, (c) attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to the Site, overloading, “flooding,” “spamming,” “mailbombing” or “crashing,” (d) sending unsolicited e-mail, including promotions and/or advertising of products or services, or (e) forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting.
