  1. Hi!
    When you look at the back cover of a Disney VCD, it says:"This VCD is not to be exported, re-supplied or distributed by way of trade outside Malaysia or Brunei without authorisation from Buena Vista Home Entertainment".
    So can I buy VCD there and sell them here?

    Simply, those VCDs are probably not legal in Malaysia either!

    Even if they were "not illegal" from some loophole (I'm not a lawyer), you can be pretty sure that the product did not pay the relevant royalties involved.

    As such, bringing it into the US would be illegal as would reselling it.

    For example, say explosives were legal in country A but illegal in country B. I could buy and sell explosives then in country A but it doesn't mean that I can then take it into country B and sell it right?

    I just wanna say that you can get EVERYTHING imaginable software wise, DVD wise and other fake stuff like watches etc.. in malaysia for very cheap. example adobe 7.0 $4. Windows xp $5. Is this stuff legal? They sell it everywhere (except online) Is it legal to bring it back to US. ????

    They are sold in retail outlets. If customs checks you you just say I bought it. Customs doesnt check people from malasia anyway.

    I think that customs only check single items, which are on their lists of forbidden goods (like alcohol, tobaco, explosives and such) and have to check the value (tool free up to a certain limit).As long as an item is only for personal use, it's not on such list and the value is beyond the import limit, there should be no restriction for such goods.
    If they suspect, that you might sell such items (if you try to import more items, than needed for personal use), you are regarded as trader.Now trade laws come into the play.And with trade laws, you have to struggle with copyright owners and such.

    In Europe there are no such limitations. A shield product can be import and sell "as is" to costumers. Unshield or using a product is another thing than buy it, import and re-selling!
    This is the major difference between US and EU. In US there is no seperation between the use of a product and the market action of a product.

    So what this disc marks, counts for US, not for EU!

    What does the legal term "by way of trade" mean in this case.In EU, this means, you are a professional dealer (with a valif/legal license), who trades such items for money.As such, you are bound to these restrictions.Otherwise elling such things second hand is not illegal (depends on the amount: at 7 pieces or more such deals are considered professional).
