    How I understand the DMCA to be is..
    If the source video has hit analog, (non digital source, Satellite etc..) and I record it (a TV show) with a computer capture card.. Then I have not broken the DMCA as it has been broadcast in a non-Propriety format, and thus falls under fair use?

    Or?
    Because the tv show has not "touched" a VCR then it's tainted and it's illegal?

    Ok.. thanks for posting.. by WHY is it illegal?
    I was under the impression that once it hits analog its falls under the "fair Use", and all the conditions that that implies.

    Reason, okay the DMCA is a very wide law, it covers almost all video,audio,digital entertainment. They would look at it like this, it is ours, you made an unauthorized copy,now you die. Even if they wouldnt bring up the DMCA, you would almost certainly fall into copyright infringment.



    Put it this way, pretty much anything you could think to do to a file is illegal in thier eyes.

    the DMCA would nullify the "fair use" clause, which is why it hasn't take full effect yet,


    There are some powerful people who are for fair use and they haven't worked out all the details.
