Nothing. You can use whatever you want, from free Handbrake to Avid Media Composer (or you can spend more if $1600 for Avid seems cheap) as long as it meets YouTube's basic upload specs which you can find on their website. If you really don't know what you're doing you can use YouTube's crappy free software. Whatever you submit, YouTube will reprocess it anyway.

What does "not for commercial use" mean? Do you have free (or not free) trial app you hacked a user code for? Or apps sold only for use in private operations or security installations, etc.? If you see enough YouTube stuff, you'll see watermarks and logos from unauthorized software all over the place. Why cheat those who design video software? There are plenty of free editors around.

YouTube automatically re-encodes everything that is uploaded. Any information in the headers regarding the software used to create the video will be obliterated.

  5. I definitely understand that commercial use means for profit when you provide service and charge for it while using your software for it. For instance, by your software you have either converted or authored, or prepared DVD from wedding, or confirmation, or Birth Day and chanrged for it.

I am not quite sure about YouTube, as I know some get paid for a number of clicks under ones video. I think could mean some kind of profit and could be considered as commercial use, at least I would double check on that.

There's another type of license "for Home use" and again I am not quite sure how that could differ from "non commercial use".

    it usually does

Non commercial use: you don't make money of the video. This includes putting it on a website (even if it's not yours) where you get money from advertisement and similar.
