APD Changes Stance On Mardi Gras
    02/07/02 - 5:32 pm

Austin Police have announced they will not be ticketing women who bare their breasts for Mardi Gras this year.

Police wanted to enforce a state disorderly conduct statute to make sure clothes stay on, but that won't be happening.

It won't happen because APD found that it's against the law, at least in Austin, to prevent women from being topless..

Police said they've been advised by the city attorney's office that the APD does not have the legal grounds to arrest women who bear their breasts for disorderly conduct.

The department still holds that disorderly conduct started last year because of toplessness and drunkenness with men crowding in to see the women.

Protestors have decided to work with police this year to designate a safe time to bear it all.

"We ask all women, who feel the need to show their breasts, will do so at 11 p.m. Saturday night, at 6th and Trinity, for an organized and safe protest, the police can the protect our safety, and our right to protest topless," Caroline Estes with the Topless Protestors said.

The protestors will meet Saturday on Sixth and Trinity, but women will retain their right to bear their breasts, at any time.

People can still be arrested for assault for any grabbing or aggressive behavior.
