  1. As all of you may or may not be aware of I am currently off work because I have had a constant headache for about the past three months.

    It started of as a weeks holiday that took me 10 weeks to arrange (I only work in a team of 5) so I have gone on holiday but really it is only a weeks sick. My governor knows that I am not feeling well but as we are such a small team I cannot really go sick as I am the only one who 100% knows how to do my role.

    So I go see a consultant and he says have another two weeks off and signs me off (in the UK to have time off officially from work you need a certificate from your doctor) I tell the powers that be, they are not happy buy they have to accept it. I had a cat scan last Tuesday (see previous thread) all is okay. I am still getting the headahces, they have subsided a bit but are still prominent so the quack says have two more weeks off and then go back. I tell my boss and he says "Ok see you Monday week", happy days as I was looking forward to going back.

    I get a call today while I am down the boozer from the HR department saying "sorry, they feel you will keep taking sick days (remember I do not get paid if I don't work) and you have been replaced".

    WHAT A BUNCH OF UNPROFFESSIONAL **** HOLES

    I now have to go through the whole rigmorale of interviews and shit again. I am pretty much one of the best in my field in London and New York so I do not think I will have much trouble finding a new role (hopefully start Monday to keep you know who happy) but I am amazed at how badly I have been treated. I have tried calling both of my X-bosses to get the 411 but they are ignoring my calls.

    For future reference for the rest of you don't trust anyone.

    Call a labor board if one's available. In the US they can't fire you for a legitimate medical reason and you are entitled to some sort of workers compensation or disability for living expenses. Not sure in the UK though. They just might be wankers at your employment and need a good Irish bottle jammed up their a**es. Just remember, if that instance comes up, you want to lay first dibbs on smashing that bottle.

  7. To repeat whats been said above, talk to a industrial relations lawyer.

    The downside of pursueing legal action is that it may hurt your future employment prospects because that sort of thing can scare an employer away from hiring you.

    True, but again, in the US that sort of thing is not allowed to be placed on any permanent record of the employee filing. The only way anyone would really know is if it became publicized by media. Problems like that usually don't get shown too often, unless involved with a large corporation or local business. The other downside is $$ for legal attorneys. However, there usually are some that will do it for free unless you win and they get you every penny you should have, plus enough to cover their costs. But again, In the UK, not sure how well you can go after them. You'll have to check that out on your own.

  9. IR laws in the U.K. suck. I doubt that you have much of a case (Adam?). IR laws in Australia will mirror yours or worse fairly soon. Best of luck finding a new job - I bet its a better one too Your previous employers sound like a bunch of arsehats.

    Here in the US we just go lock, load and pay a visit to the old office, do a six months in psych eval and go back to work at a new job.

    I hate when people use the ethnic minority route to just try and get money. They raise the cost of products, halt employment, cut the salary increase ability and precentages, and profits get cut to fund programs that are already doing fine and are inplace working, so the trainers do more research on what they already have answers to.

    A woman at on old office pressed a suit against the company for the fact that she was discriminated for her color and sex. She had gotten wind that all of the people in a certain management position were all white males and she applied for an opened position in that management team. She was declined. The fact that most of the candidates had 6-8 more years of school, 10-12 more years of experience, and have been with the company longer didn't seem to phase her. She came with the idea that it doesn't matter what the person knows, but that it should be equal for all people to work at that level. Last I heard she had quit and was forced to drop the case by her lawyer. Also the team had a hispanic gentleman and a black man. The Hispanic had very fair skin, and the black guy was an IT guy that was rarely ever outside of his department. The position was filled buy a white male, but a woman was hired 8 months later when another guy retired. And her resume was also top end with tons of schooling and experience. People need to take a better look before they jump to conclusions.

    I hope you get back in somewhere soon, and hopefully with a nice payraise. more importantly i hope your headaches are just stress or eye strain (that one is a bitch, you had your eyes checked?)

    Maybe this'll be a good thing, plenty of time to give to your cleaning endevaour with your pal.
