    Disc Jockey Arrested for On-Air Gag


    AUSTIN, Texas - A radio personality who wore a ski mask into a convenience store as part of an on-air prank has been charged with making a terrorist threat.



    Dan Chappell, known to listeners of radio station KHFI as "Lunchbox," walked around the store narrating events on air using a phone before buying a pack of gum and leaving. He was arrested a short distance from the store, police said.


    Chappell, 22, was charged with making a terrorist threat and faces up to a year in jail and up to a $4,000 fine. He did not immediately return a phone message Thursday.


    Although no verbal threats were made, store clerk Atif Akhlaque said he thought he was going to be robbed and pressed the silent alarm.


    It was the latest in a series of on-air gags by Chappell, who also has had a bikini wax, walked across hot coals and married a listener who was paid $100.

    I would have done the exact same thing. If someone walked into my convenience store wearing a ski mask I would immediately assume that I'm about to be robbed, unless it happens to be freezing cold outside. Sure you could tell it was a gag after hearing some of his conversation on the phone, or by observing the fact that he wasn't making any threats or demands, but the clerk probably triggered the silent alarm the second the guy walked in the store, which is perfectly reasonable in my opinion.

    yep , the clerk did the right thing... plus in many areas it is illegal to wear a disguise or mask ...

    ski masks are not to common in texas ...

  5. The DJ is an idiot! I hope they toss him in the clink for a while. What a dumbass thing to do! If I were the clerk I'd be suing the DJ and the radio station....

    He's lucky the clerk didn't pull out a gun and shoot him on the spot. I guarantee you that if that clerk has worked there for more than 6 months then he has been robbed by someone wearing a ski mask at least once in the past.

    Being officially charged with "Terroristic Threats" when not a single word was spoken is complete BULLSHIT. Sure...the DJ is damn lucky he didn't get his head blown off but whose idea was it to make wearing a ski mask "illegal" and how does wearing a ski mask transform into Terroristic Threats?

    Ummm, well since no one but criminals wear ski masks in convienience stores in the middle of July, I'd say criminals did....

    The law is known as criminal intent. He intended for the clerk to think he was a robber/terrorist, or what ever, there for he's guilty.....

  12. I wouldn't be surprised if it does under the Patriot Act. I can't say for sure, but if thats what he's charged with I'd be willing to bet money on it.

    Amazing. How on earth could anyone think he was about to be robbed by a man walking up to a counter, buying some gum, then leaving. I agree, wearing a ski mask in July is stupid, but the the clerk is going to have a hard time convincing anyone he thought he was going to be robbed by a man he just sold gum to.

    Plus the fact the DJ left the store. The clerk may find himself in trouble for triggering the silent alarm under false pretenses if he had no reason to feel he was being robbed. Buying gum is not attempted robbery

    If you carry a fake rifle into a bank, do the Feds "really" care?

    Intentionally causing panic / fear, is it a crime?

    What if the owner of the store had a heart condition, and died because he thought he was going to be robbed. Is the guy in the ski mask guilty of anything now?

    If the store clerk was afraid of black folks, thats one thing. If he intentionally alters his appearance to cause a panic, then its an entirely different story.

    Criminal intent is act of planning or about to plan a crime. Wheteher you look like you were or not has no bearing. Anyway, it would have been nearly impossible for a reasonable to believe the clerk felt he was about to be robbed. If he did feel that way, why did he sell him the gum?

    That is not really correct. Criminal intent is when you reasonably believe that what you are doing may be considered a crime. Since the dj expected that the clerk would reasonably believe that someone wearing a black ski mask in July would be there to rob him, then the dj acted in a manner to cause someone to believe it was a criminal act. The criminal intent took place when the dj put on the mask and entered the store. Everything after that has no bearing at all.

    I am not willing to bet on whether or not he walks. Nor would anyone else with any experience with our legal system. Still does not change the facts. By putting on the mask, his purpose was to have someone potentially believe he was about to commit a crime. That in itself is illegal. I'm sure he had no intention of harming anyone, but he certainly did intend to scare somene. The crime was committed before the clerk ever sold him gum. That has nothing to do with it.

    However, you are probably right. He will most likely walk....

    Before he walked into the store he announced "On-Air" that he was doing it to get reaction out of the clerk. Did he expect the clerk to laugh?

    If you thought you might be killed, i think most people are inclined to "Do As They're Told".

    If you fill a gun with blanks, then jump out of the bushes in front of someone passing by and yell "Die MotherF%*@!%#" as you pull the trigger, what reaction would you expect? (you intend no harm, but you do intend to frighten)

    Good thing the evidence wasn't considered during your deliberations. He may have gotten off scot free. I'm glad nothing gets by the Constabulary Intelligence Test. It's what makes our judicial system the envy of the entire world.

    Well, you know, when a cop claims to have been an accident investigator for ten years, then can't tell you how many feet in a mile.....liar, or idiot?

    His excuse....."When I need to know things like that, I look it up"

    They tried to stop the kid because his car stereo was too loud, and he ran. They wanted to tag him with felony evasion, but the facts didn't support it. So we convicted on the misdemeanor. Now I saw the kid's car on the way into the courthouse, and the driver's front quarter had been repaired and primered. Seems to me like he hit something, but it wasn't presented as evidence, so I had to ignore it. Otherwise, the kid might still be in jail!

    Well, as I said, it was the cop's own testimony that made it impossible for me to convict him on the felony charge. If someone who was an accident investigator for years has no clue how many feet in a mile, then he is not presenting facts to prove the felony charge. Since the kid admitted to trying to outrun the cops, we convicted on the misdemeanor. I have no problem with the logic used in this case.

    Now, going back to the original thread, if I were on this guys jury, I would certainly not convict the dj of terrorist acts, but I would sure as hell find him guilty on lesser charges.

    Actually it is the opposite. Since he never intended to rob the store but play a joke, there was no criminal intent in that regard. He did simply and clearly break the law on masks etc which every state probably has, but there is no need for determination of intent on that part, it's obvious. Quite the opposite of intending to sell pot even though it's oregano.

    If he had made verbal threats etc, then even as a joke there would have been intent. Without that he simply wore a mask.

    And rediculous they charged him with terrorist acts etc, the actual crime he committed is the only thing he should be charged with. Of course they will plead it out to the lesser charge.
