  1. Has anyone here ever been hit by a car while walking?
Last night around dusk, I was riding the hood of some morons compact car. I was walking through a crosswalk when a car came to a stop in front of me, but then decided to floor it. Did my best to grab the gap between the windshild and the hood so I wouldn't wind up under the wheels of the car. Spent the next 4 hours in the hospital. The good thing was that it happened on the sidewalk outside the hospital's emergency room's parking garage and the person that hit me worked for the hospital. Time from accident to seeing a nurse was about five minutes. The bad thing is that I tore up my ACL in my left knee. My knee is about the size of a basketball and my lower back is pretty tender.

Morphine is a good drug....I think....

  3. Wow, I am glad you are relativly ok.

I was never actually hit, but I was missed by only about 3 inches. The car was going about 20mph in a parking lot. The jerk did not even stop to say they were sorry or see if I was ok. They just kept driving.

  4. when i was 12 i was riding my bike and a car was pulling out of a parking lot and i ran my bike in to it. the front tire went inside of the wheel hull, i wound up jumping off my bike and landing on my feet (with drink still in hand!). the front rim was pretty damaged, but i got a replacement. the people driving the car were old & freaked out. i got away without so much as scratch. pretty fortunate, considering how badly it could have went.

    Laugh if you want:

When I was in 5th grade I had a racing bike. I was going down a steep hill in my neighborhood and going pretty fast. Then a cat ran across the street directly in front of me. I hit the car with my front time and flipped over the handle bars. I did a complete flip in the air and landed on my right wrist. It bend my hand back to my arm fraturing it in three places and also busting my pinky open. I then slip 4 feet on the road on my face. THe cat now has an area on it's side that doesn't grow hair.

    Other than that no crashes.

Guess your wife doesn't post here, or you're playing fast and loose with your health.

Sorry to hear that, my cousin got hit by a truck when he was like 14, pretty badly. Messed him up to, but he recovered and I hope you do also. Take care.

  10. Get well soon Stiltman

Never been hit myself, but had a friend who had a very close call when we were kids, around 10 years old.

The road was Flemming way, (which is just of the magic roundabout if you read that thread). There were about 5 of us together and we crossed the road when the coast was clear, but one of our friends was lagging behing and running to catch up. Anyway he ran out into the road (where we were now safely on the other side) without looking. He crossed the first lane ok, but there was a car coming towards him in the second lane, he just kept going. The car was doing about 40 mph and as he was running the tyre of the car actually removed the shoe from my friends trailing running foot. Apart from taking his shoe off, he was compltely unharmed (pysically anyway) he was pretty shaken up, but extremely lucky.

Dude, that's almost the same thing that happened to me...except I was 15 and the numbnut was exiting the freeway. The guy gave me $50 to forget the whole thing,if I wasn't so shook up I would of asked for more.
    I was also lucky..not a scratch.

    BTW..Get well soon stiltman.

  12. Hope you'll be better for the new year parties, Stiltman!

I was hit once going over a roundabout on my bike (pushbike, that is). Car pulled out on me and we hit sort of diagonal. I was lucky - I wasn't hurt at all. He wasn't moving very fast, but I was which is what made it look bad to the other drivers going around who stopped to help. The driver was an elderly man, and he pulled over and stopped. Poor old chap was more shaken than I was!

I told him to forget it - no harm done so what's the point? Just look more carefully in future! I bet that for the next month, every time he saw one of those personal injury claims adverts on TV, he would be just waiting for the phone to ring...

Speaking of bicycle accidents, I was riding home one day and my brake lever fell off my handlebars and got lodged in the spokes of the front wheel. I broke about a quarter of the spokes out and got launched over the handlebars onto the pavement. Fortunately, I was about 100 yards from home.

  14. I nearly caused a bike accident today.

Retarded teenager on the bike wasn't paying attention at all to where he was going so comes out in the middle of the road as I'm coming along. Doesn't even notice me so I blew the horn and the kid nearly stacked it in the process of shitting himself.

Almost been hit several times. Most of them while crossing the street and some moron making a right turn doesn't feel like I got the right of way. Oddly, all those times its been women drivers. A couple of times I've almost been hit by men. One time it was completely my fault. I just darted out into traffic. One time I was crossing and some guy runs a red light and almost hits me. Then he has the nerve to look at me like what the hell was I doing.
I got a question here. Outside the US, do pedestrians have the right of way? Or can drivers run over people and blame it on the person run over? When I went to Mexico City, there were a couple times I got lucky. If you cross the street on a red light, you still have to watch out for cars turning from the other side cuz they don't stop. Its funny too cuz even public transportation buses don't make a complete stop. You have to jump on and hope you make it on OK.

  16. Pedestrians have the right of way on a pedestrian crossing. But if they just walk out into the road and are hit by a car, it would be the pedestrians own fault.

Except here in the US where you may not get charged with any criminal conduct but the civil lawsuit against you afterwards will bilk you of all you're worth

On another note, and this is going to seem terribly trite considering the circumstances, but you may want to check the grammatical validity of your title. Or maybe you just got hit harder than you think

I was about to say the same thing. If the pedestrian darts out in traffic, its their fault but they can still sue the pants off you.

Here in Italy, it depends. If the pedestrian was in the crosswalk, and driver had a chance to stop, it's the driver's fault.

Thats just silly, if a pedestrian was so inclined, he could jump out in front of a car giving the driver no chance to stop. Even though the driver has the right of way he can still get sued ?

Can the driver sue the pedestrian for bending his bumper ?

Not necessarily. There is a doctrine called last possible chance. It puts the majority of the liability on which party had the last possible chance to avoid the accident.

That's when everyone breaks out the charts, computer animations, experts, etc. Which ever side piles it up the quickest and has it in the neatest pile wins.

  26. Tons of students walk up to campus at the university where I used to attend, and everyone knows that pedestrians have the right of way. I used to get so pissed when drivers would see me in the crosswalk but wouldn't stop to let me get by. I'm not stupid, so I would let them go by, but every now and then I liked to lunge forward at the last moment and act like I was gonna make a break for it and try to cross. It scared the crap out of them! It always made me feel a little better because I could point and laugh at them once they passed by and had wet their pants, although my wife says its childish and that I might cause an accident. Ha ha good times...

Just a follow up. My left tiba is broken right at the knee joint. They also think I tore my ACL. The 31st I go in for another MRI now that some of the swelling has gone down. I still have to get a MRI on my lower back as it is starting to hurt more.
