  1. In 15/Jun/2011 I bought a HDD of 3TB Seagate.
    Seller " dglet" in Ebay , website : www.digitalet.com .
    I paid 213,94 USD. Ebay item : 200618609405

    He sent a USPS Tracking LN768042161US .
    Before completing 45 days, I complained that I did not receive.
    After claiming 3 times, he said he sent another.
    USPS Tracking LC229739178US .
    This tracking LC229739178US is not recorded in USPS.
    After 30 days I complained again. Since then he has done nothing to
    solve the problem. Not respond to messages sent by Ebay.
    I've asked many times for it to return the amount paid. He did not return.
    EBay does not answer my messages. In response to the automatic Ebay
    tells me to plug in phone, but do not know how to talk in English.
    So this salesman "dglet" and his website are also scams
    the buyers. Do not buy from Ebay seller "dglet" and much less
    in website www.digitalet.com it.

    They are a top rated seller on eBay, so it's not like they are scamming you. If after 75 days, you should open up a claim with eBay Buyer Protection - but they have a time limit that you might have exceeded.

    If you paid with a credit card, then open a fraudulent transaction claim with your bank.

    You should never, repeat NEVER have your funds deducted directly from your banking account via PayPal. Once that is done, all the risk for non-delivery, fraud, etc, falls on you. With a credit card, the bank will take action for you.

    every purchase by Ebay are paid via PayPal, a Credit Card utiizando
    (Visa, Mastercard, etc.).
    The time-out dispute on ebay / paypal is 45 days.
    The seller has DGLET pontução high, but in this case he wants to apply
    a coup, because it left even answer my requests.
    He does not charge solution by the USPS company, which is very bad service.
    It questioned the USPS and they are bad even respond. They say they are not
    responsible if the package disappears. An insult, and a total lack of respect
    heritage with others.
    In this case, the payment was made on 15/Jun Invoice and went to the bank in
    early July and has already been paid.
    The seller "dglet" (website www.digitalet.com ) this is in bad faith.
    Thousands of points they have on Ebay, should be more American, because he knows
    that if he committed this crime with Americans, he can do very badly.
    What is certain is that in this case, it is being irresponsible and trying to apply the coup.

    If you used a credit card, then open up a fraudulent transaction case with them. If the laws in Brazil are like the laws in the US, then the bank will investigate the transaction. If they find that a fraud has occurred, they will refund your money.

  5. I have been selling for more than 10 years on Ebay. You won't like some of the things that I will say, but this is how it is: (based on a lot of own and shared experience)

    1.- You are from Brazil. In my own experience (and this is agreed by a LOT of other sellers), you NEVER EVER ship to Brazil or Italy as they are the most troublesome countries to ship to. You can even see that stated in many seller's shipping terms. Nothing personal, it's just that shipping to those countries means trouble almost always.

    2.- Please note that the "tracking numbers" that you provided are not actual tracking numbers but customs forms numbers. They can be used to find a package at your postal office over there, but they are not meant to be used as tracking numbers. Most of the times they only show progress at the origin point (sometimes not even that) and fewer times a follow up including an international departure, but that's about it. VERY FEW times I have seen an actual "delivered" update with a customs form numbers. True tracking numbers are issued to the most expensive services: International Priority Mail and International express mail, and they depend on the capacity of the destination country of "reporting back" the delivery.

    3.- When you buy something on Ebay, Ebay and Paypal have the seller grabbed by the balls, meaning that for whatever reason the buyer has, they can have their money back for up to 45 days. They can say something very stupid as a reason, it will get them their money back. I have sold Laptops in non-working condition for parts only for $50-$70 depending on the model, stating that they are not working, showing pictures of broken screens (the worst ones) and I am VERY careful about my descriptions... yet I have received complaints from customers stating that they were not "in working condition".......
    My point is, whenever you buy something on Ebay, you have 45 days to start a claim. If you haven't received your item in about a week (a Month is enough for an international shipment) then you must contact your seller so you can give him the other two weeks to work something out with you. If by the 44th day he hasn't made it right for you then on the 45th day (tops) you MUST open a claim because if that day passes then you are on your own. (you can always go to your credit card company, but that is another story).

    4.- You state about USPS that, and I quote: "They say they are not responsible if the package disappears. An insult, and a total lack of respect heritage with others."
    I disagree with you. If you didn't insure your package then they are NOT responsible for it, specially in an international shipment. They are responsible up to the moment your package is loaded in that international flight. Once it is in your country then the USPS has nothing to do with that delivery, it is all in Brazil's post office's power. What kind of shipping service did you use?, did you send something worth $200 uninsured and with a low priority service?... then guess who's fault it is.

    I'm just playing devil's advocate here, don't think that I am against you, but you really missed all the deadlines to file any possible recourse either with Ebay, Paypal, and maybe your credit card given the time that has passed since the charges occurred. (that depends on the amount your CC gives you to file a claim).

    I understand that the burden of proof is on the seller, to demonstrate that the item was delivered to the buyer, but that was your fault, to allow that much time to go by without opening a claim or even leaving negative feedback.

    At this point, I really think your only option is your CC if the time frame to submit the claim is still available.

    I agree with you on almost everything he wrote.
    But here's the facts:
    - With 35 days, I started to complain to the Seller;
    - He asked me to wait few more days;
    - With 40 days I asked him to give a solution.
    Otherwise I would open a dispute and transform it into a claim on Ebay;
    - Then he said he sent another package, which is tracking LC......... ;
    - He showed that he sent another, and asked that I should refuse one,
    if both appear here;
    - Theoretically as the seller took the necessary steps to send another,
    Ebay understand that the problem was solved, am I right ?
    - I paid the freight, (around 24 USD) is what he offers on the product page.
    - If the seller wants to be responsible, he should always make sure to
    have coverage in case of loss, theft, etc;
    - We know that USPS is bad service in any service and it is
    with huge debt and need urgent financial help.
    So, what to expect many people who process the packets ?
    The risk of theft is high.
    The entire world knows the USPS as a company very bad .
    - The post office in Brazil in my concept is bad, is theft, lack of
    commitment, but the service is tracking lower, and they pay compensation;
    - I think USPS absurd to say that the company has no commitment to
    the packages that you are delivered. She receives payment for a service and
    says he has no responsibility ? Absurd ;
    - I do buy in the U.S., China, Korea, Japan, UK, Canada, and in many
    other countries and the only company in trouble is USPS.
    You can see everything that is forum in the world do people complain too BAD USPS ;
    - Regardless of anything, the seller is responsible for object sold,
    so that it reaches the destination. For this, the seller needs to provide safe and
    make it explicit in the announcement the sale ;
    - This seller is dishonest, though he has a good score on Ebay.
    - I missed the cancellation deadline also for my Credit Card
    (here are only 60 days after the invoice due date);

  7. I think that we will have to agree to disagree about USPS. I have been using them heavily for the past years and while they are not perfect, they are a very good service. I have sent thousands (yes, thousands) of packages using it and I've only had a handful of "lost" packages with them, and it's always the ones without tracking that get lost, and makes me think that a few buyers got them but claimed that they didn't anyways. Since you as a seller can't leave a negative for a buyer anymore, there is no way to know if the buyer is doing this frequently... but that is another topic.

    In your particular case what you had to do is giving the seller the option to send the item again, but with a fresh NEW TRANSACTION, not the old one. That way you had 45 days again to start a complaint if something happened. When you accepted him to send it again, you accepted that the 45 days were going to expire and basically you forfeited your chance to open a claim.

    40 days into it, you want to send me another one?, sure!. Refund my first payment, I'll pay you back immediately and we start over, that way I, as a buyer am protected again and have the time to wait for the "new" package to arrive. If he refuses then you open a claim and get your money back and you are free to buy it from another seller.
