I bought some +R dual-layer disks to try dual layer burning. 10 pack of Verbatim 2.4 +R disks,they are marked to support high speed burning. I burned one with Nero on my Pioneer 109,it burned at 6x. The disk I copied was an episode disk with 8 half hour episodes. Nero placed the layer-break between episodes 4 & 5. I'm assuming this because there is blackout of a few seconds between the episodes. Is it possible Nero analyzied the disk and placed the layer-break at the end of a PGC to minimize the layer-break?
The disk I copied had about 7.5 GB's and I notice that Nero did not burn the disk to capacity,made the layers the same size?
The second disk I burned on my NEC 3540A with NTI software. Again the disk burned at the Nec's maximum of 8x. I notice that this dsik is burned to full capicity.
Do different burning programs treat the layer-break differently? Or is this controlled by the burner?

Because of the way DL disks are created and burned, the layer break must be at the half-way mark in the data. In your case you were fortunate that it fell where it did, but this was pretty much chance. Was the second burn the same content as the first, or different and therefore perhaps larger ?

From what i understand it's the burning software.I've tried rnm 7.3 and copy to dvd on my nec 3540A. Both times a the layer break there was a 2-3 second pause before play resumed.This was with ritek d01 media which may not be a good test. i'm going to try verbatim and see if there is a difference.RNM 7.3 is supposed to be the best at this.

Just rip the DVD with decrypter or shrink to an ISO and burn with decrypter. It will be an exact copy of the original including the layer break.
No DVD can withstand the power of DVDShrink along with AnyDVD! -
I'm with jtoolman2000 on this one. I assume those discs were not cheap. So, why take chances?
There is a thread here of more than 280 posts from people discussing the problems they had with Nero trying to burn dual layer discs (it has options that can be tricky, ignore the layer break, set the layer break (most people do not know their are strict rules for where a layer break can occur), allow Nero to set the layer break, remove the layer break -- screw up in the slightest manner, and you will get coasters.
If you do not need to edit, or re-author, or convert, then why take chances?
Use DVDDecrypter, the latest version. Rip it using the "MODE: ISO READ R" option. Then, burn it using the "MODE: ISO WRITE W" option.
And, why rush the burning speed, if the discs cost a lot of money?
I have used the above method for 26 dual layer burns, with 100% success. I always use Verbatim (since they are widely reported as be far the most reliable when it comes to dual layer discs). Why not let others be on the cutting edge of experimentation with their dime? If you are interested in experimenting, then I take all of this back. Find that thread about " DVD+R9 Double Layer first burn: problems with layer switch" here, and read up on all of the various methods, and their quirks, and their coasters, and their occasional successes.
But, if you want results, open up DVDDecrypter, grab some Verbatim DVD+Rs, and you will have a bit-for-bit duplicate, with no compression, with picture and sound identical to the original, and with the layer break exactly where it was on your original commercial disc, and complete success.

I done a two title dvd to fit ona double layer burnt with nero and come the end of the first title the disc freezes an dvd player cant read the movie

You might search for that thread, read it, and see if you can determine which setting you may have screwed up on, since it can be so confusing. Or, try a different software package for dual layer burns.
Nero CAN be made to work, but you need to proceed with caution.
