THe other program 123 Studios makes is called DVD Copy Plus and it uses Smart Ripper, DVDx and VCD Easy. They just give a tutorial on how to use them. I think it's kind of a rip off. Does anyone know what freeware program DVD X Copy uses? They charge a $100 for it.

This company (or its "president" at least) is a fool. The CNN article says it all really.
His program is definitely illegal and his believing that a court will ALLOW for him to use some sort of DeCSS routines in his commercial program is fantasy. If a court does so, basically it over-rides the entire spirit of the DMCA (and other equivalent laws across the world).
Of course, everyone would like to see this happen but it should be obvious that it will not.
The access to fair use of content you own (even if it involves breaking CSS) is a grey area -- arguable "legal" from some perspectives. However, breaking CSS at a commercial level (i.e., selling a DeCSS device) would definitely not be acceptable to any court.
