  1. yeah yeah I know the bit rate is to high,

Ok used CCE to create my .mpv file and used DVD2AVI to rip the audio but when I try using Scenarist to author my vobs it hits a problem prompting me with the error message "bit rate to high, blah blah blah"

    how can I fix this?

shall I re-do the multipass in CCE setting the Max bit rate to 9500 or 9000 ?

I've also noticed if I tried to author without the AC3 audio file it creates the vobs perfectly, so it seems the AC3 audio file is just pushing the bit rate over the knife edge causing the error

    any ideas

I think the total dvd bitrate can't be over 9800kb/s. What I would do is use Rempeg2 to lower the bitrate of the video stream. It's faster than reencoding.

  3. Fast than reencoding? You've got to be kidding..... ReMpeg2 is VERY slow. Reencoding with CCE is much, much faster, and higher quality to. I can do 8 or 9 passes with CCE to 1 pass with ReMpeg2 (assuming you set ReMpeg2 to settings that give you it's best quality).

If your total bitrate is greater than 10.08Mbps, then Scenarist (and any other authoring package worth its weight) should give you an error. Add up ALL of your data streams (ie, all audio files and all substream files, plus your video bitrate). These should never exceed 10.08Mbps. If you have your video encoded up to 9.8Mbps and your audio is 384kbps, then you will most likely fail to compile (max BR ~ 10.18Mbps which is above the spec). Try re-encoding your audio to 192kbps.

I'm saying faster than two pass VBR using Tmpeg. Rempeg2 is about 2x as fast as that (I can do a 2.5hour movie in just under 6 hours.) Now I'm not going to get into a debate as to which encoder gives the looking stream but when I use Rempeg2 I can't tell the difference between it and the original stream. Also Rempeg2 is free and I don't have the $250 (or $2000) to pay for CCE.
