Each I, finished encode, video has always been hardsub

Can't you disable subtitles? If so it might hardcode using some of your installed filters like vsfilter.

Or convert with something else like xmedia recode, handbreak, hybrid etc.

if, disable subtitles, subtitles will disappear when completed encode

He's saying he WANTS the subs to show once he's done encoding, but they are not there.
