There are software companies which already sell encoders that use Nvidia or AMD/ATI GPU-acceleration. Surely they have been granted patents by now too, and probably well before Microsoft.
Somebody else could still be granted a patent for a sufficiently different GPU accelerated encoding process than the others. This does not seem to me like something we need to worry about. -
It's not GPU accelerated video encoding in general they are trying to patent, it seems just to be a method of GPU powered motion estimation.
