  5. Only in America can you do something wrong like texting while walking and blame it on someone else. I am ashamed that she is stupid and the city will get sued for it. If she did not see an open manhole, what makes her think she would see cones?

    It's her right to sue. Winning a judgment on the other hand, is another story altogether. What jury or judge in their or his right mind going to give a bubblehead money for being a bubblehead?

    I remember the McDonald's incident. I agreed with jury. McDonald's had been told countless times their coffee was too hot. This fact plus that their coffee was so hot it caused THIRD DEGREE burns on the plaintiff was the deciding factors that won the day for that unfortunate grandmother.

    It is possible to be sued or charged if you harm an intruder, but in most states and countries, you cannot profit from a crime (as in, sue for being injured while committing a crime).

    And yet millions of people, applying common sense, did not receive any burns at all from that dangerous product. It's not as if a McDonald's employee poured it into her lap. She was trying to hold a styrofoam cup full of very hot liquid between her knees to add cream/sugar. McDonald's had also been told countless time that they had the best coffee in the fast food industry, demonstrated by their sales. I, for one, stopped going out of my way to buy it, after they lowered the temperature, because it was no longer superior.

    You avoid them? Do you at least scream and shout at them to watch where they are going? I would let them walk into me, that way they learn more than if everybody just lets them walk blithely on.

    Take down the license plate number, pull over and call them in for unsafe or careless driving and oh btw mention it was due to the cell phone glued to their ear.

    Or if driving a big rig (rental not your own) blow the air horn to wake them up as you mash the accelerator to the floor. You'll probably win if you do hit them.

    I do know their is a such thing as the last clear chance doctrine, and if the person in front had the last chance to avoid the accident, such as slowing down sooner rather than waiting for the last second to brake, he may very well be liable. Highly unlikely, but as TBoneit asserts, quite possible.

  16. In Florida, if someone "illegally and forcibly" enters your home, you may assume that they mean you serious harm and are authorized to use deadly force. No direct threat is necessary. Further, as long as the intruder faces a criminal charge, you are specifically protected from civil action of any kind.

    Now in Ohio, at least several years ago, you were required to jump out the window of your own home rather than defend it or yourself in any way. You could not shoot an intruder with a baseball bat, however if you used a crowbar (equivalent threat) you would be OK.

    The teenager will probably win, despite her stupidity an unmarked open manhole represents negligence by the city.

    She may very well have a case. I remember working for Target, and if we discovered a spill on the floor, we were to stop whatever we were doing, stand near the spill, call for help (we all had walkie-talkies), and wait for someone else to come and clean up the spill. Our duty until the spill was cleaned up was stay near the spill to make sure no shoppers approached the spill. If the utility men had practiced a form of this, one man would have stood near the hole, keeping pedestrians away from the hole until his partner came back to clearly mark the hole.
