  1. I read somewhere that this is just a value set somewhere in the data stream
If so, it is possible to change the default aspect ratio of wmv without re-encoding it?

(those files specially were 16:9 in the raw avi format, but after the compression to wmv, since i didnt have that option to set in the encoding program, they start as 4:3 now, and people look unnaturally tall and thin :> )

Since your original is 16:9, you can set a flag to the video to project as 16:9. I do not know any free software, but DVD Remake can do it for sure.
It will not re encode your file, just change IFO file.
You may be able to do it in IfoEdit, that one is free, but I am not sure about that one.

You are right, missed the part about wmv. Remake will work on DVD files.
I thought you want to make a DVD.

I'm not sure if it's possible to change that flag after the fact (could change how it's supposed to be encoded).

I do know that if you had encoded with WME you could have set the aspect ratio. 1st you would edit the encoding profile, on the "Compression" pane, to "Allow non-square pixels"; this will un-grey (activate) the Pixel Aspect ratio settings, on the "Video Size" pane.
