This is what I want to do

I currently use Tmpgenc to author a dvd of australian idol performances in order as per each show

Easily done ........

But what I also want to include on the dvd is a menu that will play each artist .... i don't want to have to include the same file as I have already included them in the episode menu

Is there a way to include a menu that references the already incuded files per singer?

You need an authoring tool that supports playlists. DVD Lab Pro is one that can do this. You would put all your clips into a single title, as normal. You would then add chapter points at the start of each clip. Finally, you create a Chapter Playlist per artist that contains only chapters with that artist's performance.
