DivxToDVD usually handles MP3 VBR and AC3 audio fairly well, but that's what I would check for. Drop the AVI file into Gspot and see if one of those is present.
If so, you might want to take out the audio and convert it to a MP3 CBR audio and mux it back in with VirtualDub before running it through DivxToDVD. -
sounds too complicated for me to understand haha, im still an amateur at this
the avi file is perfect, audio is in line the whole way through
im guessing(hoping) i just need a different converter instead of that complicated process lol -
When offered advice, you should at least consider it before saying it's too hard. Most of th epoeple who have been around here a while know what they are talking about and have seen most of these problems before.
Redwudz is right, it is probably VBR MP3 audio. DivxtoDVD handles this better than any of the one-click programs, so it it having a problem, you have no other choice but to do it the hard way, or give up.Read my blog here.

Sure, try another converter .... but not WinAVI, please !
I think you'll find that redwudz's advice is bang on the money. The other thing is that we have no idea of what source you're using, and our crystal balls are generally pretty good, but not that good. Help us to help you by providing all the information you can about your source file(s), such as GSpot screencaps. There's a sticky here:

... that may assist you with this.If in doubt, Google it. -
If not Gspot, drop it into VirtualDub Mod. If it's VBR (Variable Bit Rate) audio, VDMod will tell you immediately.
Then you can extract the audio as a WAV file. jimmalenko made an excellent guide for this.
https://forum.videohelp.com/viewtopic.php?t=280779
Then you can take the WAV file, select it with VDMod and mux (Combine with the video.) it back in and save that combined file. (We can tell you how to do this.) Not that hard.
Put that combined file into DivxToDVD and it should convert it as usual.
I should tell you that if you DL video files from the internet, you will run into this problem fairly often. You might as well learn how to do it.
