It is wrong to record a movie from TV and distribute or download it! So why is it ok (according to a vague forum rule) to download TV episodes, which are very much as copyrighted as a movie?

  2. I don't know if it's wrong, but it is illegal..... Maybe it's okay if commercials are left in? Still illegal though...

It is perfectly legal to record any broadcast off the television. It is illegal to distribute it or to download such a recording. This site is run by an individual, and he has complete control over what is allowed or not. Its his decision, that's why its allowed. I think its wrong too, but its a decision we all just have to live with.

The issue isn't whether downloading TV episodes is warez, rather if it is allowable here. The answer is yes, so the point is moot. If Baldrick says that talking about cocaine is okay, but heroin isn't, that's the final word.

Also, to clarify, no one is (probably ever) talking about downloading movies recorded from TV. More likely it will be about a DVD rip, screener, or cam.

One other little tidbit: When you record an episode from television, there's no copyright blurb like DVDs have (FBI warning). That's one little loophole that can be explored. Just like it's legal to park in an area as long as there's not a No-Parking restriction of some form visible.

Finally, when a place you work at (especially for free) goes against your beliefs (whether those beliefs are or are not in the name of legality), then it's time to disassociate yourself with that place of business (in this case, the website).

It is MORE wrong than backing up a rented movie but LESS wrong than downloading a warez game depending on if you also have watched the show on TV with commericals and if the show is available on TV.

As for legality, I think the others covered that well.

I'll have to dig up the thread, but Baldrick basically clarified himself and reversed his previous position a bit.

he now says that taping / capturing tv episodes and sharing them with close friends and family is okay, but trading / distribution / uploading / downloading and p2p'ing them are not okay, as far as discussions on this board are concerned.

    Here is the thread.

If I had to render a guess, I would say because episodes almost always go syndication and will be shown over and over on television. Since the exact same show is on several times then viewing rights are public.

To be perfectly honest, I never really gave it much thought. I think the whole debate is pointless.

  9. Baldrick has never said it is ok to download, upload or provide links to copyrighted material whether it be TV shows or movies, this is what he actually said.

it is not okey to requests tvshows here.
it is not okey to link to tvshows.
    then it is warezing.

sharing captured tvshows with your closest family / friends is okey but not with the entire world.

    this is my rules...no laws.

According to those rules, you can discuss it, but not upload it, link to it, or share it with us.
