5 months and $30k fine.
Fair??
Unjust?
Appropriate?
I think it is probably appropriate. I didnt think she would get convicted let alone serve time. Maybe 1 year would have been better..
Just imagine youre a billionaire. You inside trade to make about $50k. You get 5 months and pay $30K. $20k net gain(we'll leave legal fees,etc.out).
That is $4k/month you receive for your time. Lets say she makes $60 mil/year. That =$5mil/month.Definately worth it![]()

I'm sure in the long run it won't hurt her that much. Apparently on the day of her sentancing her company's stock rose 37%

Who cares? In my opinion, it was a government vendetta and the sentence amouted to no more that a slap on the wrist. So her secretary has to reschedule the next board meeting for five months later, and charge the petty cash account $30,000(or Martha has to look in her change purse to pay it). I would hate to think how much time I would get for insider trading. Trees probably wouldn't live that long. The horror. The HORROR.

GuestGuestI'm sure your right.Shes rich. I just like the irony in the figures.$4k when she probably makes $5mil a month. She makes $116/minute ,every min of the month.Originally Posted by Grimey
As far as the stock increasing, it is still at about 80% of the pretrial value.

the company is still at only 1/2 CAP value it had before ...
the big increase on stock price that day was kinda weird -- speculators mostly i guess ..

she got a slap on the wrist and will continue to make money even if she serves 5 months of jail time which is a joke to begin with.
i don't call that justice at all, it's just the government cleaning house.
-
I agree that this was just a slap on the wrist.
She deserved a longer prison sentence.
Just goes to show you once again that if you are rich, you can get away with murder.
Just look at O.J.
He still get's his pension, and he did not go to prison. -
but think of it this way ...
1. she is serving the same time as other people apx. with the same amount of money etc. involved ..
2. when your 62 years old and living as a billionare and in the lap of luxury , 5 month in any jail is going to seem pretty harsh ..
3. though she submitted false expenses - she is not charged with that (internal mater)...
4. she i believe (along with others) should have been made to pay the courts expenses which total several million ..
people like the bakers were a lot more criminal in thier intent and who they stole money from and how much and there is the real criminals of this sort ..
even leone helmsley ddint get much more than this and she hide millions (in not paying taxes) plus was a major SOB to people"Each problem that I solved became a rule which served afterwards to solve other problems." - Rene Descartes (1596-1650) -
The biggest problem with the Simpson case, in my opinion, there really wasn't that much to convict him with. no witnesses, no motive, too many other people who could have done it. All the neat little tests the CSI people had, they screwed up so much, the prosecutor never had a chance. But mainly because they assumed since it was a black man, they would use the amount of circumstantial evidence it normally takes. No luck there, as the jury wanted to see more than that since it was O.J.Originally Posted by gitreelHello.

Ken Lay has to be breathing a lot easier after all of this.

What is OJ's web site? http slash slash......
This lady get some strip searches. 5 months of that should do it. I don't get what her probation period is about though. What can't she do? -
She wasn't tried or convicted of Insider trading. I think it was a big scam. They only went after her because shes famous and her only crime was lying to the man. What a waste of tax payer money....
"Terminated!" :firing: -
OJ wasn't convicted of murder either, so obviously it was all just a big frame job whitey tried to case a brother up with all in the name of keeping the black man down.

I doubt it, what was the amount of the Martha Stewart trial about? Around 50 or 60k. You talking many millions when it comes to Ken Lay additionally the other guy in the Marthat Stewart case is going to jail for 7 years if my memory serves me correctly and even he didn't take as much as Ken Lay allegedly did. If convicted he's going to jail for a very long time.Originally Posted by sacajaweeda
I think it was a fair judgement but I doubt any of this would have ever even come up if she wasn't Martha Stewart.
FYI if Martha Stewart and the rest of them had held onto their stock they would have turned quite a nice profit. Isn't that a kick in the ass.
Oh on OJ cmom do you really think he didn't do it. The glove don't fit LOL sure if you flex your hand it won't. -
I don't know if he did it or not. I was in Arizona when it happened and had no way of knowing for certain he did it. By the way, how do you know for sure? If you saw him do it, you know Marcia Clark wanted you to step up and testify. What happened when society needed you most? The best they could do was a wimp named Cato and a bigot named Furman.Originally Posted by thayneHello.

She also got 5 months home confinement and 2 years probation.
Five months home cofinement! In her home.....that's not punishment, she should have to spend it in my home.If it works, don't fix it. -

You don't get wrongful death sentences. Civil courts can't hand out sentences, dude. And if he did "do it" beyond a reasonable doubt, he would be in the joint, right?Originally Posted by gitreelHello.

OK, let me rephrase that. There was a wrongful death decison against him.
He owes more money than he is worth.
He was stripped of his heisman.
He still gets his pension -
Trust me, the fact that Simpson owes more than he's worth and still lives in a Florida Mansion laughing at the State of California and the Goldman and Brown Families means nothing to me. And I didn't try to correct you, I did correct you, forcing you to rephrase what was in you last post.Originally Posted by gitreel
Many corporations (and you can believe OJ, like many rich people, is one) receive wrongful death judgments against them, and still have no trouble operating. Deal with it. I only said that no one knows for certain if he did it or not. Civil suit notwithstanding.Hello. -
The ONLY reason Stewart is getting any jail time at all is that she truly is a rude, ignorrant, arrogant bitch. What she did happens daily and is brushed under the rug daily by judges.
When you step on as many toes as she did to get to where she is....you're a target and devervedly so. -
GuestGuestOne of the few times I'd have to agree with TK. I'm not convinced either. I still think it might have been one hell of a frame job.Originally Posted by Tommyknocker

Martha Stewart proves once again that the ultra-rich and powerful live and repent by a dufferent set of rules than the rest of us. Joe Lunchpail would have been fined $100,000 and sentenced to 5 years for that crime.
As for OJ being framed ....come on .....
Juries can be wrong. Having served on a jury 3 times, one of them a murder trial, I can say that they're just human and make mistakes too.

what is not fair is that her crime did not hurt anyone directly (except herself - losing her control on her own company as a result) BUT becuase of the fallout of this trial -- the advertisers pulled out MS OMNIMEDIA and they laid off 200 people ....
