    Just to keep it light and continue the argument, it's not a direct circumvention.
    Whether direct or indirect, it is still circumvention which would violate the dmca so therefore it would still not be legal.

    I don't know about that...ITunes itself is giving you the option to burn CD's, right?
    This means, you're "allowed" (in their viewpoint) to remove the DRM/CopyProtection if you go this route, as AudioCD's don't have such a thing.
    Then, you go-"I want to rip these (unprotected) Audio CD tracks", well was there anything in your iTunes agreement that says "I WILL NOT RIP SUBSEQUENT CD TRACKS"? If not, it seems to be legit.

    I think that with the ability to burn to disc, the implication is that this function is for portability, not for format change. Since the audio CD spec does not allow for AAC, the format change is for that specific, limited reason.

    Here's a little bit of the TOS (note the bold):
    You shall be authorized to burn a playlist up to seven times.

    You shall be able to store Products from up to five different Accounts on certain devices, such as an iPod and iPod mini, at a time.

    Any burning or exporting capabilities are solely an accommodation to you and shall not constitute a grant or waiver (or other limitation or implication) of any rights of the copyright owners in any content, sound recording, underlying musical composition, or artwork embodied in any Product.
    iTunes is specifically there to sell iPods. Of course they don't want you to format-shift for anything other than iPods, but they allow burning so that they look like the "good guy".

    I still think they left the door open, and, for a great many of us on these boards, fair-use backup doesn't violate their copyright.

    Slightly OT (and hopefully not out of bounds):
    US folks--support DMCRA (or whatever the consumer-rights DMCA amendment is called now)! Get involved and message your representatives! Let 'em know there are lots of angry consumers out there.
