Funky A05 behavior?

I'm running 10.2.8, latest versions of Toast, DVDBackup and DTOX, but around 90% of the time when I quit either DTOX or DVDBackup, and eject a DVD, it doesn't go, the trash looks empty, but no disc popping out, and I have to restart to get my disc out. It's an aftermarket Pioneer, but it is eesentially an exact Superdrive, iDVD recognizes it as such, has anyone else had this happen?

I had that happen a few times, typically restarting solved the error but its never persisted.
does it happen all the time?

Almost constantly, it's kind of weird, but it doesn't matter whether I've recently restarted, it happens with different apps running, sometimes nothing but OSX, sometimes with Classic in the background, very, very strange.....

or perhaps run one of the tool disks (drive 10, disk warrior 3) etc
