    Okay. We ALL know it's wrong to download these songs without paying. Anyone here that doesn't, needs to go back to Ma & Pa to get versed, again about the "golden rules".

    Having said that... most of us want somethin' for nothin'. It's that simple. When I heard about Napster, I couldn't get the software downloaded fast enough. The same with Kazaa Lite.

    The catch for me, though, is most of the songs I would paid for are unavailable except at garage sales and ebay. They just can't be found in my local music stores.

    Unless the industry wants to release "oldies" and music stores want to stock them, I'll get them anyway I can. I have a couple of bootleg (I'm partial to motion picture soundtrack's) cd's that were never released. That's their choice not to release them. Mine is to break the law and get 'em anyway.

    So, I will never be a paying customer either by online music or music store, as they don't have what I want. Only people that already have the older music have it.

    About the "singles" disappearance... They did get greedy and look where it got them Does anyone know which "Band" started that? Was it Zepplin with "Stairway to Heaven"?

    PS: I must confess that I downloaded a "few" songs that are in the music stores while I was at it, but it wouldn't have made any difference in royalty payments to whomever, as I wouldn't have bought the songs on my own anyway. Just not worth paying $15.00 for a song.

    [Moving slightly OT and talking about Singles vs. Albums]

    I was around when singles were king (60's). Albums didn't really get going until 70's with FM rock stations wanting to play extended cuts (ever see the Movie "FM"?), but it wasn't until the arrival of the CD that singles started to die. For a while, RIAA was against doing just albums, even though that's what the artist liked because of the "continuity". Even during 80's w/ disco, punk etc. there were singles incl. dance cuts. Then CD's became the norm and the record companies knew that while Joe Blow was used to $1.99 for a single/$7.99 for an album--if it was getting increased to $16.99 for a CD album, what should they charge for a CD single? Most tried a few, but at what, ~$5.99? for a CD single, people aren't that much of fools. That's why it died out.
    Now the RIAA doesn't want to sell singles outright, even though the marketing strategy behind selling albums is TOTALLY singles oriented. And now they "agree" and "support" the "artists' requests" to mainly have albums. Sheesh, what a turnaround.

    I believe everybody should be able to get and use fairly what they pay for or work for.
    I also believe everybody should pay for or work for whatever they get...

    I don't agree at all with what the RIAA is doing these days (and hope they get burned), but I do want the artists to be reimbursed for their stuff and don't want them to get ripped off (either by RIAA or ME, or "them pirates over yonder" or YOU).

    I will continue to use Kazaa(lite), etc., but I'm trying to make sure I'm getting personal/publicdomain/shareware stuff.

    Hmmmm...... thats funny........ i remember about 6 or 7 years ago, maybe longer, i asked a friend if he wanted me to burn him some cd's, copies of "ORIGINALS" i had, he said yes, then the next day he said his wife wouldn't let him, it was stealing........ Hmmmmmm...... i said, how many time have you or your wife made copies if music on cassette, for themselves or friends over the years, he said quite a bit..... Hmmmmm..... but his wife said because it was on cd, like it made a diff. i said it's just a diff. medium. so they were not stealing unless it was a cd

    So i guess basically, anything you copie to share with a friend, whether it be your own music cd, album, DVD. and this was before 99% of the people i knew even had a pc, let alone downloading files from others with programs as kazaa, even now, about 98% of the younger people i know get more music from trading "ORIGINAL" cd's, making copies and passing them around without downloading, and i personally hate programs like kazaa or the likes because most of the stuff is crap videos, people who don't even know how to make a good comnversion or compress the hell out of them, like a full movie to 100mb..........

    Also i read in my last audio/video mag. , it might have been my last pc magazine, that file sharing as kazaa was not even a factor to be blamed for the music industries profit losses, they said from studies it was that more people were spending their E.T. money on dvd's, and that the music industry has been putting out less titles & cd's over the last few years and raising their prices, while dvd's have been comming out better & more with more to offer for almost the same amount of money.

    Hmmmm..... i don't know or worry about it......... when staind's new album was coming out, i downloaded their single, listened to it for a couple of weeks, went out the first day it was released and bought the cd.
    so i guess i was tech. stealing, but was i after i bought the cd and copied for a friend when she asked me to for her personal use ??

    Let me answer a few questions for you.

    Do I think that the RIAA is wrong in what they are doing? Yes. Do I think that CD's are way overpriced? Yes. Do I like communism? No. Can I get away with taking a BMW Z4 for free? Doubt it. Do I say ignorant, uninformed stupid things? Not often. Does this topic make me uncomfortable? No. Are there a lot of things that are overpriced? Yes

    Will the RIAA win and continue to be the big bully? No, technology will find a better way to sell music. But until then, it is still illegal to download music. There, I have said what I have to say. Go ahead and call me all the bad names you want. It's always the ignorant ones that do.
    Hmmmm..... i'm not trying to start anything here but i don't think music or anything in this post falls under warez ?? maybe i'm wrong ?? but i can admit it if i am..........

  7. Chaos, i believe that under fair use you can make a backup of your own cd's for yourself, and no one else. I don't even think your allowed to make a backup of a friends cd for that friend. The warez rules were pulled straight from the AUP, so as to being against forum policy, i think it is. YMMV

    The discussion of the issues surrounding file sharing / RIAA / price fixing / consumer rights, etc., in themselves does not necessarily breach the no warez rule in the AUP.

    As long as it isn't advocating warez, then I think it's okay, though it is a grey area of the AUP. Other moderators may have a different opinion and they may lock it/warn members before do.

Many artists are thankfully not re-signing with major labels and are going at it themselves. If t hey sell their music for $1 per song or $5 per CD, a 70 minute CD, with a online group, selling 100,000 copies will make them more than selling 1 million would with a record company.
    The industry should change, but I do not agree that this will simply be accomplished by encouraging everyone to steal copyrighted material via p2p. In any case, this IS a violation of the AUP in terms of the "advocating warez" rule.

    You totally took that quote out of context. Totally missed the point and warez or links to warez were not there.

    If youo read the context you would understand. The only violation here was taking something out of context and not understand a post or anm opinion.

    You would be better served to send a private message when you do not understand something, rather than taking things out of context.

    What is to take out of context? You are clearly advocating the use of p2p programs to distribute copyrighted material. Sure, your intention is to engender industrial change, but that isn't really the point. Hell, I agree with most of your post.

    However, suggesting to all and sundry that they should continue to use p2p programs to spread (from the context of your post non-free) content is against the spirit of the AUP. The fact that it does not impact on "profits" does not make it any more legal. The fact that you consider (perhaps rightly) that the RIAA are ripping of the consumer does not make it any more legal either. It is still a clear violation of copyright and one that is not protected by Fair Use. The means does not justify the end.
