    There are software companies which already sell encoders that use Nvidia or AMD/ATI GPU-acceleration. Surely they have been granted patents by now too, and probably well before Microsoft.

    Somebody else could still be granted a patent for a sufficiently different GPU accelerated encoding process than the others. This does not seem to me like something we need to worry about.

  3. It's not GPU accelerated video encoding in general they are trying to patent, it seems just to be a method of GPU powered motion estimation.
