    Hmmmmmm ....

    Almost exactly the same thread titles by the same member, about an hour apart, after the first one gets locked due to warez, and presumably about the same thing, but worded slightly differently ...

    Where do management sit on the issue of downloading a movie that you own on DVD that is damaged and therefore unable to be backed up ?

    (I've put this in Feedback, as I don't know whether it's reportable or not)

    Hi,

    I seem to remember reading a mp3 thread about this. I think somebody said it would be ok to burn a cd from mp3's if the original was damaged/destroyed since you do own the original.

    Don't know if it was a mod or not and not sure if they'd apply the same concept to downloading a movie if it were damaged.

  5. thats a joke,he backed up a dvd,and miraculously its changed into a divx,and its split into 2 folders,and he wants to reconvert back to mpeg to watch...yeh right,suuure that first link is ok..its worded differently to the second,which is blatant,but still,the first link is a blatant lie,and easy to see through..
    if i backed up my dvds to my hard drive and they changed to divx on the way,im sure id make a fortune marketing that software.
    wonder what software he used,dvddecrypter2divxonthefly!!

    Backing up to a DivX file is nothing new (and is quite OK under Fair Use), but it does seem strange (as BJ_M points out in the first link) that he/she has had the presence of mind to split the backup into CD1 and CD2 files, considering he/she then doesn't know how to convert CD1 and CD2 files back to DVD ???

    Certainly the first link, on its own, seems legit and is exactly the reason why we take backups of things - so that we have a copy in case the original goes bad. No dramas there. However, given the close similarity of the two threads, as well as their close proximity (about an hour apart), it doesn't take a rocket-scientist to figure out that he/she is talking about the exact same thing. If he/she isn't, and just happens to have purposefully backed up another DVD to CD1 and CD2 files, and is asking about that set of files, I'll eat my hat

    But still, benefit of the doubt I guess - no titles were mentioned, the magic "d" word (download) wasn't mentioned either, so ...

    I was more interested in the general question I posted:
    Where do management sit on the issue of downloading a movie that you own on DVD that is damaged and therefore unable to be backed up ?
    ... and I guess I'm sorta asking this from a legal point of view first and foremost (would this behaviour be covered under US Fair Use), and then secondly from this site's perspective, which, as I understand, pretty much says that if it's covered under US Fair Use, then it's OK. BUT OTOH, if it's downloaded, it must be public domain. So which takes precedence ?

  7. Of course FairUse would not cover it. The ownership
    rights would be limited to the item bought,
    not the film itself. I also doubt that anyone would
    be bothered to take court action over it. Ask Adam.
