i have the latest version of mainconcept MPEG encoder and im trying to convert this divx movie file to DVD format but the output files audio is always out of sync and really slow/choppy. If i extract the audio to WAV with virtualdub and use that as the source audio file, the output is fine tho.

Anyone know what could be causing the choppy/delayed sound or is there no way around it?

Your divx movie may have damaged structure. MC Enc will still try to do the job but the outcome may be as you see. Try to run your AVI through Divx fixer of some sort and encode it again. Out of sync may be corrected later.

VBR Mp3 with an incorrect header is usually the culprit. When you save it out as wav you correct the error and create an uncompressed file.
