is there anyway to get the video out of the bin with out the cue, so i can open it with TMPGEnc. this bin is a svcd.

Yes, you can write your own .cue, or choose burn image from file and
select the bin in Nero or similar burning app. I think the latest versions of Nero will warn you if you are burning to the wrong mode and sector size - so you can adjust accordingly.

I did not read your question correctly. To quickly extract the mpeg
from a bin file (without a cue) use BIN2ISO and then daemontools
to load the new image as a virtual cd- then simply copy the mpeg
file to the hard drive. Using Tmpgenc with the mpeg2 plugin (see tools section on left hand side) you should be able to load the video
directly into tmpgenc.
If you run into problems with this step, try
adjusting the directshow settings in tmpgenc(see common tmpgenc problems guide) or learn how to use DVD2AVI to frame serve the file to tmpgenc.
