I have tried with a number of different files, basically after creating a valid mpg for burning if I use TMPGEnc and split the file in two the resulting mpg files return an error when you try to create the vcd with them,if I then accept and request to burn anyway, the size is misreported and the burner will not accept saying not enough space on CD

Whoops, looked like I solved my own problem, the correct button would be worth looking at wouldn't it.

Make sure you choose the correct option in the drop down menu when cutting. The default will give you errors.
