persisting bug with MsMPEG4v2

I haven't figured out the magic ingredient that goes wrong, but I am still getting the applescript error:
"The variable _frameratey is not defined. (-2753)"
with some quicktimes (which seem fine/well-formed in every other way)
when converting quicktime to MsMPEG4v2
current problem one is 848x480, 24.00 fps and has 16b stereo audio
problem persists whether i choose to encode audio or not.

aha! manually changing the frame rate to NTSC film seems to improve things (but why would it not like a framerate of 24.00?)
